LAW OF GEORGIA

ON ESTABLISHING THE LEGAL ENTITY UNDER PUBLIC LAW (LEPL) CALLED '112' OF THE MINISTRY OF INTERNAL AFFAIRS OF GEORGIA

 

Chapter I - General Provisions

 

Article 1 -  Purpose of the Law

This Law aims to establish the LEPL called '112' of the Ministry of Internal Affairs of Georgia ('112'), and to define the main principles and areas of its operation.

 

Article 2 - Legal basis for the operation of '112'

The legal basis for the operation of '112' is the legislation of Georgia and the Statute of '112', approved by the Minister of Internal Affairs ('the Minister').

 

Chapter II - Main Provisions

 

Article 3 - Legal status of '112'

'112' is a legal entity under public law established under this Law and operating under the Ministry of Internal Affairs of Georgia.

 

Article 4 - Purpose and main areas of activities of '112'

1. The purpose of '112' is to ensure operational and effective management of emergency aid through coordinated activities with other authorised entities in emergency situations and in other cases provided for by the legislation of Georgia, and for this purpose, to receive information through a single telephone number '112'.

2. The main areas of the 'activities of '112’ include:

a) receiving, processing and evaluating information on emergency situations and other cases where emergency aid is necessary and providing appropriate agencies with information to enable further action;

b) coordinating with other authorised agencies to manage emergency situations and other cases where emergency aid is necessary;

c) registering, analysing and producing relevant statistics on emergency situations and other cases where emergency aid is necessary;

d) cooperating with appropriate agencies and/or institutions of Georgia and foreign countries on issues falling within the competence of '112';

e) exercising other powers provided for by the legislation of Georgia.

3. Emergency situations and other cases where emergency aid is necessary, which fall within the area of the activities of '112' , as well as the functions and powers of '112', are determined by the Statute of '112'.

4. A normative act of the Minister may be issued on issues specified in paragraph 2 of this article.

 

Article 5 - Management and representation of '112'

1. '112' is headed by the Director, who shall be appointed and may be dismissed by the Minister.

2. The Director of '112' shall:

a) represent '112';

b) make decisions (issue legal acts) on issues falling within the competence of '112';

c) appoint and dismiss the employees of '112';

d) administer the funds and property of '112' in the manner established by the legislation of Georgia;

e) exercise other powers determined by the Statute of '112'.

3. The Director of '112' shall have deputies, who shall be appointed and may be dismissed by the Director of '112'.

4. The number of deputy directors and their powers are determined by the Statute of '112'.

 

Article 6 - Structure of '112'

1. '112' shall exercise its powers through its structural units.

2. The structure and competences of the structural units of '112' are determined by the Statute of '112'.

 

Article 7 - Property of '112'

1. In order to achieve its goals and perform its functions, '112' shall own property; the procedure for the formation of such property is defined by the legislation of Georgia.

2. The property of '112' consists of fixed and operating assets, as well as other tangible assets and financial resources, which shall be reflected on the independent balance sheet of '112'.

 

Article 8 - Funding of '112'

1. The sources of the funding of '112' are:

a) funds allocated from the State Budget of Georgia;

b) funds allocated from the budgets of local self-governing units;

c) fees for '112' services;

d) revenue received from work performed under a contract;

e) other revenue permitted by the legislation of Georgia.

2. The Government of Georgia shall determine the fee for using '112', and the persons required to pay the fee, and other related issues.

3. All the funds and revenues specified in paragraph 1 of this article shall be used for achieving the goals of '112' and for promoting the development of the system of the Ministry of Internal Affairs of Georgia.

 

Article 9 - State Control over '112'

The Ministry of Internal Affairs shall exercise control over '112'.

 

Article 10 - Procedure for terminating '112' activities and for liquidating '112'

The activities of '112' shall be terminated and it shall be liquidated in the manner established by the legislation of Georgia.

 

Chapter III - Transitional and final provisions

 

Article 11 - Transitional provisions

1. Before 1 January 2012, the Minister of Internal Affairs of Georgia shall:

a) approve the Statute of the LEPL called '112 ' of the Ministry of Internal Affairs of Georgia;

b) appoint the Director of the LEPL called '112' of the Ministry of Internal Affairs of Georgia;

c) ensure the implementation of other organisational activities necessary to establish the LEPL called '112' of the Ministry of Internal Affairs of Georgia;

2. The Ministry of Economy and Sustainable Development of Georgia shall ensure the transfer of property necessary for proper functioning of the LEPL called '112 ' of the Ministry of Internal Affairs of Georgia, in the manner established by the legislation of Georgia.

 

Article 12 - Entry into force

This Law shall enter into force upon promulgation.
