Article 1 - Scope of the Law and legal grounds for the activities of the Intelligence Agency

1. This Law determines the status of the Intelligence Agency (the Agency), its authority, the basic areas of its activities, goals and principles, the legal grounds of service by employees of the Agency, and the social and legal protection guarantees for employees of the Agency.

2. The Agency shall conduct its activities on the basis of the Constitution of Georgia, international treaties of Georgia, this Law, the Law of Georgia on Intelligence Activities, the Law of Georgia on the State Security Service of Georgia, and other legislative and subordinate normative acts of Georgia.

Article 2 - Agency

The Agency is a state sub-agency within the jurisdiction of the State Security Service of Georgia (the Security Service), which carries out intelligence activities to protect the national interests of Georgia.

Article 3 - Basic areas of the activities of the Agency

1. The Agency shall carry out intelligence activities in political, economic, scientific and technical, and informational and ecological fields, and participate in the international fight against terrorism within the limits of its competence.

2. The Agency shall also carry out foreign counter-intelligence activities.

Article 4 - Basic goals of the activities of the Agency

The basic goals of the activities of the Agency shall be to define foreign threats and risks and provide necessary intelligence information to the country's state and political officials in order for them to make decisions in political, economic, defence, informational, and ecological fields and other fields of national security.

Article 5 - Basic principles of the activities of the Agency

The basic principles of the activities of the Agency shall be:

a) lawfulness;

b) protection of the State's interests and of human rights, freedoms and legal interests;

c) objectivity and impartiality;

d) political neutrality;

e) accountability, professionalism and competence;

f) unity and centralisation;

g) determination;

h) operativeness;

i) continuity;

j) planning;

k) secrecy.

Chapter II - Activities and Authority of the Agency

Article 6 - Scope of activities and authority of the Agency

1. The Agency shall be accountable to the head of the Security Service. The authority, organisation and rules of operation of the Agency shall be determined by this Law and other legislative and subordinate acts of Georgia.

2. The Agency has a seal with the image of the state coat of arms of Georgia on it and its name, as well as its own symbols, the samples and rules of use of which shall be developed and approved by a normative act of the head of the Security Service in accordance with the procedures established by the Law of Georgia on Symbols of State Importance.

3. The Agency shall be located in Tbilisi.

4. The Agency shall exercise its authority abroad, as well as in the entire territory of Georgia, within the limits of its competence.

5. The Agency prepares intelligence information on issues within its competence and submits/provides it to the Prime Minister of Georgia, the highest government bodies and relevant institutions of the executive branch.

6. In order to exercise its authority, the Agency shall:

a) develops intelligence tasks based on the national intelligence programme, as well as the tasks and priorities related to intelligence activities;

b) develop and implement special programmes necessary for the security and development of intelligence activities;

c) co-operate with persons on a voluntary basis, openly or confidentially;

d) within the limits of its competence, implement methodical, organisational, and organisational-technical measures to ensure the observance of the state-secret regime both within its own subdivisions and in the diplomatic missions and consular offices of Georgia, in accordance with the procedure determined by the legislation of Georgia; and for these purposes, carry out operative as well as engineering and technical measures;

e) use a set of necessary operative, operative-technical and engineering-technical measures in order to ensure the safety of its employees, the sources of operative information and the systems of information and communication;

f) if necessary, cipher and disguise its documentation, personnel, subdivisions, buildings and constructions and transportation means of the Agency, including by using various documents, plate numbers on transportation means and other identification marks;

g) for the purposes of secrecy, establish organisations of various legal forms, proceeding from the need of the intelligence activities;

h) within the limits of its competence, ensure its own safety, and protect its employees, its sources of operative information, its operational and technical means, buildings and constructions and informational data, from unlawful encroachments;

i) within the limits of its competence, carry out operative-investigative activities;

j) carry out foreign counter-intelligence activities;

k) use operative, operative-technical, engineering-technical, radio-electronic and other special means in order to obtain intelligence information;

l) create and/or use cryptographic systems and coding, together with other methods, in order to protect intelligence information;

m) enter into contracts with enterprises, institutions and organisations (irrespective of their legal form), based on the need to carry out intelligence activities;

n) co-operate with other state structures of Georgia in order to ensure the safety of property, facilities, information and employees of the Agency;

o) after declassification, transfer historically and scientifically valuable documents of the Service to the Legal Entity under Public Law called the National Archives of Georgia for permanent storage, in accordance with the Law of Georgia on State Secrets;

p) by decision of the head of the Security Service, cooperate with relevant services of foreign countries on issues related to national, regional and global threats;

q) create, send, receive and store any document (including archival material) in the form of a printed and/or electronic documents, as well as use a personal signature, electronic signature/electronic stamp and electronic trust services.

7. The documents of the Agency, which include data about its personnel composition and those persons and/or organisations that confidentially work (or have worked) with the Agency, and data about methods and means used by the Agency, shall be stored in the archive of the Agency and shall not be subject to declassification. The case provided for by Article 24(3) of this Law shall be an exception.

8. While carrying out its activities, the Agency may purchase, create or produce special-purpose devices and systems and operate them.

9. The Agency shall also carry out other activities proceeding from this Law.

Article 7 - Responsibility for the disclosure of intelligence information

In accordance with the procedure established by law, the heads of the legislative, executive and judicial authorities of Georgia and of enterprises and institutions and other officials, to whom intelligence information is submitted, shall be held responsible for disclosing data containing state secrets and decoding the sources of information.

Article 8 - Personnel of the Service

1. The Agency's staff list and the number of employees working in the Agency shall be determined by the head of the Security Service upon the recommendation of the head of the Agency.

2. An Agency employee shall be a person who serves in a position provided for in the Agency’s staff list and who has been granted a special state rank (agency official), a person appointed to a position provided for in the Agency’s staff list without holding such rank (agency official), as well as a person employed under an employment contract.

3. Matters related to the activities of the Agency, the rights and responsibilities of the subdivisions, and other organisational matters, shall be determined by the statute of the Agency, which shall be approved by the head of the Security Service upon the recommendation of the head of the Agency.

Article 9 - Head of the Agency

1. The Agency shall be managed by the head of the Agency, who shall be appointed and dismissed from the position by the head of Security Service.

2. The head of the Agency shall:

a) organise the implementation of the national intelligence programme and tasks and priorities related to intelligence activities;

b) ensure the submission/delivery of intelligence information to the highest government bodies and relevant institutions of the executive branch;

c) submit candidacies of intelligence officials to the head of the Security Service for posting in diplomatic missions of Georgia;

d) coordinate the creation and implementation of state standards for cryptographic means and ciphers for the protection of intelligence information;

e) submit the regulations of the Agency’s structural subdivisions, the Agency’s staff list and the number of employees in the Agency to the head of the Security Service for approval;

f) in agreement with the head of the Security Service:

f.a) issue subordinate normative acts of Georgia in accordance with the procedure established by the Organic Law of Georgia on Normative Acts;

f.b) approve the Agency’s internal regulations;

f.c) appoint and dismiss heads of structural divisions of the Agency and their deputies;

f.d) determine the amount of monetary rewards, as well as the amount of one-time assistance to be provided in special cases;

f.e) if necessary, make decisions on the issuance of supplements to the remuneration to employees of the Agency as provided for by the legislation of Georgia;

f.f) represent the Agency in international relations;

g) appoint and dismiss employees of the Agency, heads of structural units of the Agency and their deputies in accordance with the procedure established by subparagraph (f.c) of this paragraph;

h) develop and approve intelligence tasks based on the national intelligence programme, as well as the tasks and priorities related to intelligence activities;

i) encourage Agency employees or impose disciplinary liability on Agency employees in accordance with the established procedure;

j) in accordance with the procedure established by the legislation of Georgia, award the Agency's employees other special state ranks, including the rank of colonel;

k) create commissions and working groups;

l) exercise other powers granted to it by this Law and other legislative and subordinate normative acts of Georgia.

3. The head of the Agency may not hold any other position or carry out any other paid activity, except for pedagogical, scientific and creative activities.

Article 10 - Deputies of the head of the Agency

1. The head of the Agency shall have deputies, including one first deputy.

2. The deputy heads of the Agency shall be appointed to and dismissed from their positions by the head of the Security Service. The powers of the deputy heads of the Agency shall be determined by the legal act of the head of the Agency.

Article 11 - Employees of the Agency

1. The Law of Georgia on the State Security Service of Georgia shall apply to an employee of the Agency, unless otherwise established by this Law, a legal act on the procedure for serving in the Agency and/or another relevant legal act.

2. The procedure for serving in the Agency shall be determined by a legal act of the head of the Security Service, which the head of the Security Service shall issue upon the recommendation of the head of the Agency. The act may determine the guarantees of legal and social protection of an employee of the Agency, as well as regulate their incentive schemes, imposition of disciplinary liability and other issues related to their service.

3. After a special examination, a citizen of Georgia shall be hired to work in the Agency who, with his/her personal and business qualities, education and health status, is able to perform the duties assigned to him/her.

4. A person hired to work in the Agency may be appointed to a position for a probationary period. He/she shall be required to undergo a special training course approved by the head of the Security Service. The issue of exempting a person from undergoing a special training course and/or reducing the duration of the course may be determined by a legal act of the head of the Security Service. The powers of the head of the Security Service may be transferred to the head of the Agency by a legal act of the head of the Security Service.

5. A person who has at least 1 year of experience working in a unit performing the operational and/or analytical functions of an intelligence institution and/or security service may be appointed to the position of head of a division or a higher position in a unit performing the operational and/or analytical functions of an intelligence institution and/or security service. A person who does not have such work experience may be appointed to the position provided for in this paragraph only due to official necessity, with the consent of the head of the Security Service.

6. A person who has at least 1 year of experience working in a position with an intelligence-operational function, intelligence-analytical function and/or technical intelligence function at the Agency may be assigned to a diplomatic mission of Georgia.

7. The rules and conditions for the selection of an employee of the Agency, special examination of a person and his/her employment in the Agency shall be determined by the head of the Security Service, upon the recommendation of the head of the Agency, by a legal act. The said rules and conditions may be determined differently from the Law of Georgia on the State Security Service of Georgia and/or other relevant act(s).

8. An employee of the Agency is obliged to perform his/her official duties, which are determined by the legislation of Georgia, the internal regulations of the Agency and other legal acts, in a timely and conscientious manner.

9. An employee of the Agency may be granted the relevant special state rank specified by the legislation of Georgia.

10. A citizen of Georgia who has not completed compulsory military service/national military service for conscripts and is a conscript may be employed by the Agency, as well as a citizen of Georgia who is exempted from national military service for conscripts in accordance with the procedure established by the legislation of Georgia.

11. An employee of the Agency may, in order to perform his/her official duties, hold a position in an executive body of Georgia, any enterprise, institution or organisation without disclosing his/her service in the Agency in accordance with this Law. The period of work in this position shall be considered as part of his/her total length of service.

12. It shall be prohibited to use the status of an employee of the Agency for a purpose that is not related to the performance of his/her official duties.

13. The State shall provide fuel and talk time to an employee of the Agency who uses a personal vehicle and/or mobile phone in the performance of his/her official duties, in accordance with the procedure established by the head of the Agency.

14. The Agency shall provide professional training and qualification improvement to the employee of the Agency.

15. In case of necessity, based on the need, an employee of another intelligence institution of Georgia may be assigned to the Agency, remaining in the staff of the said intelligence institution. An employee of the Agency may be assigned to another intelligence institution of Georgia. Financial support for the mission shall be provided in accordance with the legislation of Georgia.

16. The remuneration of an employee of the Agency shall include salary, monetary reward and other supplements to the remuneration and compensations provided for by the legislation of Georgia. The salary shall include the official salary and rank-based salary of the employee of the Agency. The rates of the official salary and rank-based salary of the employee of the Agency, as well as the supplements to the remuneration and their rates to be granted to the employee of the Agency shall be determined by an ordinance of the Government of Georgia.

17. The procedure for reimbursing and material and technical support for long-term business trips of an official intelligence representative assigned to a diplomatic mission of Georgia shall be determined by an ordinance of the Government of Georgia.

18. The procedure for awarding an employee of the Agency with departmental badges, medallions and medals shall be determined and the samples of departmental badges, medallions and medals shall be approved by a legal act of the head of the Security Service.

Chapter V - Legal Protection of Employees of the Agency

Article 20 - Inadmissibility of interference with the official activities of an employee of the Agency and guarantees of his/her legal protection

1. It shall be prohibited to interfere with the official activities of an employee of the Agency, as well as to obstruct the official activities of an employee of the Agency by state officials, public and political associations, their representatives and other persons who are not authorised by law to interfere with the official activities of an employee of the Agency or to influence him/her in any other way. The above-mentioned action shall be punishable by law.

2. For an employee of the Agency who carries out intelligence activities under particularly difficult intelligence conditions, 1 day of service shall be considered 2 days of service. Particularly difficult intelligence conditions for carrying out intelligence activities shall be determined by a legal act of the head of the Security Service.

3. In the event of the arrest, detention or trial of an employee of the Agency and/or a member of his/her family for carrying out intelligence activities outside the borders of Georgia, the State is obliged to facilitate his/her/their release in every possible way.

4. An employee of the Agency who has been arrested or detained abroad for carrying out intelligence activities shall retain his/her full monthly salary and 1 day of arrest or detention shall be considered as 3 days of service.

5. In the cases provided for in paragraphs 2 and 4 of this article, the employee of the Agency shall be paid his/her official salary in double and triple amounts, respectively.

6. In the event of partial or complete loss of professional suitability by an employee of the Agency due to reasons beyond his/her control or as a result of his/her disclosure, the Agency, after examining the circumstances and taking into account the relevant conclusion, shall ensure employment of the said employee or create conditions for professional retraining, including reimbursement of related expenses.

Chapter VII - Legal Status and Social Protection of Persons who Cooperate (or have Cooperated) with the Agency Confidentially

Article 23 - Rights and obligations of a person who cooperates confidentially with the Agency

1. The Agency shall be authorised to cooperate with a person who has voluntarily agreed to cooperate with it confidentially with or without appropriate remuneration in order to achieve the goals of its intelligence activities. The rules and forms of cooperation of the Agency with this person shall be determined by the normative act of the head of the Agency.

2. A person who cooperates confidentially with the Agency shall have the right to:

a) conclude an agreement on confidential cooperation with the Agency or cooperate with it in another form;

b) receive explanations from the Agency's employees about his/her tasks, rights and obligations;

c) use the Agency's encrypted identity document(s) for conspiracy purposes;

d) receive appropriate remuneration;

e) receive compensation for the harm or loss caused to his/her health or property during his/her cooperation with the Agency.

3. A person who cooperates confidentially with the Agency is obliged to:

a) not disclose the fact and conditions of cooperation with the Agency;

b) not provide the Agency with false or defamatory information;

c) protect information containing state secrets entrusted to him/her or known to him/her.

Article 24 - Social protection of a person who confidentially cooperates (has cooperated) with the Agency

1. The issue of social protection of a person who confidentially cooperates (has cooperated) with the Agency shall be determined by a normative act of the head of the Agency.

2. A person who confidentially cooperates (has cooperated) with the Agency and is not a citizen of Georgia may, upon his/her request, be granted the citizenship of Georgia in accordance with the legislation of Georgia.

3. If a person specified in paragraph 2 of this article has been granted the citizenship of Georgia, the period of cooperation with the Agency shall be included in his/her total length of service.

4. No one shall have the right to request information about a person and/or organisation that confidentially cooperates (cooperated) with the Agency, except for a person authorised thereto by the legislation of Georgia.

Chapter VIII - Financial Support of the Service

 

Article 25 - Financial support of the Agency

1. The Agency shall be financed from the state budget of Georgia.

2. The allocations necessary for the implementation of the Agency's activities shall be included in the State Budget of Georgia under a separate programme code.

Article 26 - Supervision over the activities of the Agency

The agency's activities shall be supervised by the head of the Security Service and/or his/her deputy with appropriate authority.

Article 27 - Parliamentary control

Parliamentary control of the Agency shall be carried out in the form and manner provided for by the Constitution of Georgia and the Rules of Procedure of the Parliament of Georgia.

Chapter X - Transitional and Final Provisions

 

Article 30 - Transitional provision

The Service shall, within three months after the entry of this Law into force, bring its subordinate normative acts into compliance with this Law.

a) a military service person serving in the Service shall perform military service in accordance with the Defence Code. His/her social and legal protection guarantees shall be determined by this Law and other relevant normative acts;

b) a conscript may be enrolled in contract service. His/her term of service shall be determined by the Defence Code;

c) the procedure for selecting conscripts, taking training courses and for serving in the Service by conscripts shall be established by the Resolution on the Procedure for National Military Service of Conscripts in the Georgian Intelligence Service, which shall be approved by the Government of Georgia upon the recommendation of the Service;

d) a conscript shall undergo special training courses before being enlisted in the personnel of the Service.

2. A conscript who has completed contract service in accordance with the established procedure shall be considered to have completed the National Military Service of Conscripts. After completing the National Military Service of Conscripts, he shall be enrolled in the Reserve of the Georgian Defence Forces with the military rank of a Private.

3. In the event of premature termination of service by a person who is undergoing conscript national military service, on his own initiative (voluntarily) or through his fault, he shall be dismissed from Service without counting the period of service. The person shall be subject to conscription into the National Military Service of Conscripts under the general procedures.

Article 31 - Final provision

This Law shall enter into force upon its promulgation.
