Law of Georgia
on the Georgian National Academy of Sciences
Chapter I – General Provisions
Preamble
The Georgian National Academy of Sciences is a successor to the ancient Georgian Academies of Gelati and Ikalto, and is a feature of the high level intellectual development of the state, and a scientific advisor to the Government of Georgia, and a union of persons with international scientific achievements and high level scientific and civic competence.
Article 1 – Purpose and scope of the Law
This Law establishes the status, goals, objectives and the rules of activities of the Georgian National Academy of Sciences ('the Academy').
Article 2 – Legal grounds for the activities of the Academy
When carrying out its activities the Academy shall be guided by the Constitution of Georgia, this Law, the legislation of Georgia, and the statute of the Academy.
Chapter II – Status of the Academy and the Goals and Objectives of the Academy
Article 3 – Legal Status of the Academy
1. The Academy is a legal entity under public law based on membership, the members of which are the full members (academicians), corresponding members, honorary academicians and foreign members of the Academy.
2. The Academy is a scientific advisor to the Government of Georgia.
3. The Academy is a self-governing scientific institution, which approves the statute of the Academy independently, determines its structure, and makes decisions regarding scientific and organisational matters, and human resources related matters, and matters related to economic and international relations.
4. The term 'the Georgian National Academy of Sciences' may not be used to define a concept other than the one defined in this Law.
5. A member of an academy in Georgia may not be called an academician or a corresponding member or an academy member without indicating the full name of the particular academy, except for a member of the Georgian National Academy of Sciences.

Article 4 – Goals and objectives of the Academy
1. The goals of the Academy are:
a) to promote the development of science in Georgia in accordance with achievements worldwide;
b) to promote the development of science in Georgia based on the intellectual and professional competence of its members, and to present science to public life and in the international arena;
c) to promote fundamental and applied scientific research works;
d) to forecast the development of science in Georgia and work out proposals for state priorities in accordance with scientific achievements worldwide;
e) to provide recommendations for higher state authorities and the public regarding the possible results of economic and social projects that are carried out in Georgia and foreign countries;
f) to care for the official languages and improve scientific terminology in these languages;
2. In order to achieve its objectives the Academy shall:
a) popularise scientific achievements and scientific heritage;
b) hold scientific discussions, symposia and conferences, and give public lectures at general, vocational and higher educational institutions;
c) publish printed and electronic scientific journals and other periodicals, and exchange scientific literature at the international level;
d) be entitled to become a member of international scientific organisations, and to communicate with leading scientists and scientific centres of the world;
e) be entitled to carry out scientific and research activities;
f) establish and award prizes to highlight significant scientific works in the fields of science and technology;
f1) establish scholarships and select successful scientists, who are not members of the Academy, as the scholarship holders;
g) be entitled to establish commissions in different fields of science and technology;
h) keep personal archives of the figures of science and culture on the basis of a written request from an authorised person, which is valuable for the history of Georgia;
i) review and assess annual reports and completed scientific and research works depicting the scientific activities of higher educational institutions and scientific and research institutes of Georgia (except for the Legal Entity under Public Law called Kutaisi International University), and for these purposes be entitled to request necessary additional information from these organisations and notify these organisations, and the Ministry of Education and Science of Georgia, and the Funds for the Development of Science in Georgia, with regard to the results of assessment;
j) grant titles and awards in different fields for the best scientific and research institutions of the year;
k) conduct other activities including auxiliary economic activities related to the objectives of the Academy as provided for by the legislation of Georgia.

Chapter III – Management of the Academy
Article 5 – Principles of the management of the Academy and the management bodies of the Academy
1. The Academy is managed on the basis of the principles of electiveness, democracy and transparency.
2. The Academy shall be managed by:
a) the general meeting of the Academy;
b) the Presidium of the Academy;
c) the President of the Academy.
3. The positions of the President of the Academy and Vice President of the Academy are the administrative positions of the Academy.

Article 6 – General meeting of the Academy
1. The highest managing body of the Academy is the general meeting of the Academy. The full members (academicians) and corresponding members of the Academy, with the voting rights, and the honorary academicians, foreign members of the Academy present in Georgia and the Academy scholarship holders, with the right of deliberative vote, shall participate in the work of the general meeting of the Academy.
2. The general meeting of the Academy shall:
a) approve the statute and the structure of the Academy by a majority of the full members (academicians) and corresponding members of the Academy on the list (‘members on the list’);
b) determine the fundamental directions of the activities of the Academy;
c) elect the President , the Vice President, the secretary academician of the Academy, the secretary academicians of the scientific departments (‘the department’) of the Academy and other members of the Presidium of the Academy among the full members (academicians) of the Academy by a secret ballot, by a majority of the members on the list;
d) recall prematurely members of the Presidium of the Academy by a secret ballot, by 3/5 of the members on the list;
e) review and approve the annual reports of the Academy and submit a reasonable proposal for the budget financing for the following year;
f) elect full members (academicians), honorary academicians, foreign members and scholarship holders of the Academy;
g) review matters related to scientific ethics.
3. The general meeting of the Academy shall be convened and chaired by the President of the Academy, and in the case of his/her absence, by an acting President of the Academy.
4. The general meeting of the Academy shall be convened as necessary, but at least twice a year.

Article 7 – Presidium of the Academy
1. The Presidium of the Academy comprises the President, the Vice President, the secretary academician, the secretary academicians of the departments of the Academy and other members of the Presidium of the Academy determined by the statute of the Academy. The number of members of the Presidium of the Academy shall be determined by the statute of the Academy.
2. The members of the Presidium of the Academy shall be elected by the general meeting of the Academy for a period of five years by a secret ballot, by a majority of the members on the list.
3. The Presidium of the Academy shall comply with the resolutions of the general meeting of the Academy and manage the activities of the Academy in between the general meetings.
4. The Presidium of the Academy shall be accountable to the general meeting of the Academy.
5. The Presidium of the Academy shall be served by an administrative staff.
6. Other powers of the Presidium of the Academy shall be determined by the statute of the Academy.

Article 8 – President of the Academy
1. The President of the Academy is an authorised representative of the Academy within the country and abroad. He/she shall be responsible for the management of the activities of the Academy. The President of the Academy is the chairperson of the Presidium of the Academy at the same time. Other powers of the President of the Academy shall be determined by the statute of the Academy.
2. The President of the Academy shall be elected among full members (academicians) of the Academy by a general meeting of the Academy for a period of five years by a secret ballot, by a majority of the members on the list. The same person may be elected as the President of the Academy only for two consecutive terms.

Chapter IV – Structure of the Academy, Composition of the Academy and Remuneration of the Members of the Academy
Article 9 – Structure of the Academy
1. The structure of the academy shall be determined by the Presidium of the Academy and approved by the general meeting of the Academy.
2. The main structural unit of the Academy is a department, which unites the full members (academicians), corresponding members and scholarship holders of the Academy with relevant scientific profiles. The department is managed by the secretary academician.
3. The powers of other structural units of the departments and the Academy, as well as the procedures for the election and appointment of their heads shall be determined by the statute of the Academy.

Article 10 – Members and scholarship holders of the Academy
1. The total number of full members (academicians) of the Academy shall not exceed 70.
2. A scientist working in Georgia, who is a citizen of Georgia and who has contributed to the development of science at an international level and who has a high reputation in the sciences may be elected as a full member (academician) of the Academy.
3. An acknowledged public figure who is a citizen of Georgia and who has contributed to the development of science and/or culture in Georgia may be elected as an honorary academician of the Academy.
4. A famous scientist and public figure who is a foreign citizen may be elected as a foreign member of the Academy.
5. A person having a Doctor’s academic degree or its equivalent scientific degree, who is the author of internationally acknowledged scientific papers, may be elected as an Academy scholarship holder.
6. A person over the age of 50 may not be elected as an Academy scholarship holder. An Academy scholarship holder shall be a citizen of Georgia, working in Georgia. A person shall be elected as an Academy scholarship holder for a period of five years. The same person may be elected as an Academy scholarship holder only for two consecutive terms.
7. The total number of the corresponding members and scholarship holders of the Academy shall not exceed 40.

Article 11 – Election of the full members ( academicians), honorary academicians, foreign members and scholarship holders of the Academy
The procedures for the election of full members (academicians), honorary academicians, foreign members and scholarship holders of the Academy shall be determined by the statute of the Academy.

Article 12 – Remuneration of the full members ( academicians), corresponding members and scholarship holders of the Academy
1. A full member (academician) of the Academy shall be reimbursed with not less than GEL 1600 per month during his/her lifetime.
2. A corresponding member of the Academy shall be reimbursed with not less than GEL 1000 per month during his/her lifetime.
3. A scholarship holder of the Academy shall be awarded a scholarship of not less than GEL 1000 per month.
4. The amounts of reimbursement determined by paragraphs 1-3 of this article shall be allocated from the state budget of Georgia. Such allocations may not be used for any other purpose.
5. The reimbursement of full members (academicians) and corresponding members of the Academy provided for in paragraphs 1 and 2 of this article shall cease if a member renounces of or loses the citizenship of Georgia.
6. The scholarship of an Academy scholarship holder, determined by paragraph 3 of this article, shall cease if he/she renounces of or loses the citizenship of Georgia or terminates his/her scientific work in Georgia.
7. The reimbursement provided for in paragraphs 1 and 2 of this article is adequate reimbursement for the scientific status of a full member (academician) and a corresponding member of the Academy.

Chapter V – Property of the Academy, and Financing and State Control over the Activities of the Academy
Article 13 – Property of the Academy
1. The Ministry of Economy and Sustainable Development of Georgia shall transfer property to the Academy for the achievement of its goals and the fulfilment of its functions as provided for by the legislation of Georgia.
2. If a scientific and research institution, as provided for in Article 10 of the Law of Georgia on Science, Technology and their Development, is established as a structural unit of the Academy, a decision regarding the property to be transferred thereto shall be made by the Ministry of Economy and Sustainable Development of Georgia.

Article 14 – Financing of the Academy
1. The main source of financing of the Academy is the state budget of Georgia. Funds allocated for the Academy shall be reflected separately in the Law of Georgia on the State Budget of Georgia for an appropriate year.
2. Additional sources of financing are:
a) state and private funds, including international and foreign funds for the facilitation of scientific research works;
c) grants and revenues received from the implementation of agreements;
d) funds receivable on the basis of the legislation of Georgia.
Article 15 – State control over the activities of the Academy
The Government of Georgia shall exercise state control over the activities of the Academy as provided for by the legislation of Georgia.

Chapter VI – Transitional Provisions
Article 16 – Georgian National Academy of Sciences, its full members (academicians) and corresponding members
1. The Georgian National Academy of Sciences is the legal successor of the Georgian Academy of Sciences.
2. Full members and corresponding members, and foreign and honorary members of the Georgian Academy of Sciences shall automatically acquire the status of full members (academicians), corresponding members, honorary academicians and foreign members of the Georgian National Academy of Sciences.
3. Articles 12 and 14 of this Law shall not apply to the full members (academicians) and corresponding members of the Academy who have renounced of or lost the citizenship of Georgia before the entry of this Law into force.
4. The statute of the National Academy of Sciences of Georgia shall be adopted not later than six months after the entry of this Law into force.
5. Elections for the new management of the Academy on the basis of this Law and the new statute shall be held not later than three months after the adoption of the statute.
6. Elections for corresponding members of the Georgian National Academy of Sciences shall terminate as of 1 May 2009.

9. The Government of Georgia shall submit proposals before 1 June 2009 regarding the optimisation of the Georgian Academy of Agricultural Sciences and the transfer of property to the Academy as provided for by the legislation of Georgia.

Article 16 1 – Status, functions, and objectives of the Georgian Academy of Agricultural Sciences and remuneration of its members
1. The Georgian Academy of Agricultural Sciences is a legal entity under public law, a self-governing scientific institution that enjoys full autonomy and state funding, and determines the priority directions of the agricultural sciences within the country, and coordinates scientific and research work and serves as a scientific advisor to the Government in agricultural matters.
2. The Georgian Academy of Agricultural Sciences shall review and assess annual reports on the activities of scientific and research institutions (whatever their legal forms) and completed scientific and research works in the agricultural field, and for these purposes it shall be authorised, within the scope of its authority, to require necessary additional information and notify these organisations of the results of assessment and provide appropriate recommendations to the state authorities concerned.
3. The functions, objectives, rights, management, structure and members of the Georgian Academy of Agricultural Sciences shall be determined by the statute of the Academy which shall be adopted and approved by the Georgian Academy of Agricultural Sciences.
4. The Georgian Academy of Agricultural Sciences shall carry out auxiliary economic activities related to the objectives of the Academy in accordance with the procedures provided for by the legislation of Georgia.
5. The state shall finance those academicians and corresponding members of the Georgian Academy of Agricultural Sciences who have enjoyed appropriate status before the entry of this Law into force, and in the case of electing an existing corresponding member to a vacant position of an acting academician of the Georgian Academy of Agricultural Sciences before the entry of this Law into force, he/she shall receive the remuneration of an academician of the Georgian Academy of Agricultural Sciences.
51. The Georgian Academy of Agricultural Sciences shall have the right to elect scholarship holders.
6. Full members and corresponding members of the Georgian Academy of Agricultural Sciences shall receive a monthly remuneration from the state budget of Georgia in the amount of not less than GEL 1,400 and GEL 900 during their lifetime.
7. The monthly remuneration of full members and corresponding members of the Georgian Academy of Agricultural Sciences shall cease where a member renounces of or loses the citizenship of Georgia or in the case of permanent resettlement abroad.
8. If a full member or a corresponding member of the Georgian Academy of Agricultural Sciences is simultaneously a member and/or becomes a member of the Georgian National Academy of Sciences, he/she shall receive remuneration from one institution only.
81. A person having a Doctor’s academic degree or its equivalent scientific degree, who is the author of internationally acknowledged scientific papers, may be elected as a scholarship holder of the Georgian Academy of Agricultural Sciences.
82. A citizen of Georgia, who works in Georgia and who is not over the age of 50, may be elected as a scholarship holder of the Georgian Academy of Agricultural Sciences. A person shall be elected as a scholarship holder of the Georgian Academy of Agricultural Sciences for a period of five years. The same person may be elected as a scholarship holder of the Georgian Academy of Agricultural Sciences only for two consecutive terms. The procedures for the election of a scholarship holder of the Georgian Academy of Agricultural Sciences shall be determined by the statute of the Georgian Academy of Agricultural Sciences.
83. The total number of the corresponding members and scholarship holders of the Georgian Academy of Agricultural Sciences shall not exceed 10.
84. A scholarship holder of the Georgian Academy of Agricultural Sciences shall be awarded a scholarship of not less than GEL 900 per month.
85. A scholarship of a scholarship holder of the Georgian Academy of Agricultural Sciences, determined by paragraph 84 of this article, shall cease if he/she renounces of or loses the citizenship of Georgia, or terminates his/her scientific work in Georgia.
9. The Ministry of Education and Science of Georgia shall exercise state control over the Georgian Academy of Agricultural Sciences as provided for by the legislation of Georgia.
10. The Georgian Academy of Agricultural Sciences shall be guided by the Constitution of Georgia, the legislation of Georgia, this article and the statute of the Academy.
11. The number of full members (academicians) of the Georgian Academy of Agricultural Sciences shall not exceed 30. The election of corresponding members of the Georgian Academy of Agricultural Sciences shall terminate upon the entry of this Law into force.

Article 17 – Activities with regard to the entry of this Law into force
The Ministry of Economic Development of Georgia shall transfer the property to the Academy in accordance with the procedures determined by legislation within three months after the entry of this Law into force.
Chapter VII – Final Provisions
Article 18 – Act acknowledged as invalidated
The Law of Georgia on the Georgian Academy of Sciences (the Legislative Herald of Georgia, No 25(32), 1999, Art. 129) shall be declared invalid upon the entry of this Law into force.
Article 19 – Entry of this Law into force
This Law shall enter into force on 1 January 2008.
