ORGANIC LAW OF GEORGIA

ON THE NATIONAL FLAG OF GEORGIA

 

Article1

1. This Law, in accordance with Article 11 of the Constitution of Georgia, determines the description of the national flag of Georgia, as of the state symbol, and defines the procedure for using and protecting the national flag of Georgia.

2. The national flag of Georgia determined under this Law shall be the only version of the national flag of Georgia. The use of any other flag as the national flag of Georgia shall be prohibited.

3. The original of the national flag of Georgia shall be kept at a place determined by the Parliament of Georgia.

Article 2

1. The national flag of Georgia is a rectangular white fabric with a large, red, right-angled cross in the centre touching all four sides of the flag; the squares created by the vertical and horizontal arms of the cross feature four bolnur-katskhuri crosses of the same colour.

2. The standard dimensions and the exact image of the national flag of Georgia shall be determined by a resolution of the Parliament of Georgia. The dimensions of the national flag of Georgia may be changed by keeping the proportions determined by the same resolution of the Parliament of Georgia.

3. The procedure and conditions for manufacturing the national flag of Georgia shall be determined by a resolution of the Parliament of Georgia.

Article 3

1. The national flag of Georgia shall always be hoisted:

a) on the building of the President’s residence;

b) on the building of the Parliament of Georgia;

c) on the building of the executive agencies of Georgia;

d) on the building of the Constitutional Court of Georgia;

e) on the building of the Supreme Court of Georgia;

f) on the building of the National Bank of Georgia;

g) on the building of the State Audit Office;

h) on the building of the Public Defender’s Office of Georgia;

i) on the building of the office of the Chief Prosecutor of Georgia;

j) on the building of the Central Election Commission of Georgia;

k) on the buildings of other administrative bodies;

l) on the buildings of the supreme representative authorities of the Autonomous Republics of Abkhazia and Adjara, also on the buildings where the sessions of these authorities are held, during the whole period of the sessions;

m) on the buildings of the executive agencies, enterprises and organisations of the Autonomous Republics of Abkhazia and Adjara;

n) on the buildings of local self-government bodies of Georgia, also on the buildings where the sessions of these bodies are held, during the whole period of the sessions;

o) on the buildings of the diplomatic missions and consular offices of Georgia abroad;

p) on ships and other means of maritime transport, if they are registered in Georgia.

2. The national flag of Georgia shall be displayed:

a) on the means of transport that serve the representatives of Georgia abroad;

b) at official international events held in Georgia;

c) on maritime and inland waterway vessels and other means of transport, if on board of such vessels there are the President, the Prime Minister, the Speaker of the Parliament of Georgia and other persons in their official capacity and who, under Georgian legislation, represent the Government of Georgia, including the head of the diplomatic missions and consular offices of Georgia abroad.

3. The heads of the institutions specified in this Article shall determine other instances of using and protecting the national flag in their institutions.

Article 4

1. If the flag of the Autonomous Republic of Abkhazia and Adjara is hoisted together with the national flag of Georgia on the territory of Georgia, the national flag of Georgia shall be larger and hoisted higher.

2. If a flag of another country is hoisted together with the national flag of Georgia on the territory of Georgia, the national flag of Georgia shall not be smaller than that flag.

 

Article 5

1. The protection of the national flag of Georgia shall be provided by relevant state and local self-government bodies.

2. The use of a damaged, discoloured or otherwise spoiled national flag of Georgia shall be prohibited.

3. The violation of the procedure for using the national flag of Georgia shall entail liability under Georgian legislation.

Article 6

The date of the adoption of this Law shall hereby be declared as the day of the national flag of Georgia.

 

Article 7

1. Upon the entry into force of this Law, the Organic Law of Georgia of 14 November 1990 on the National Flag of Georgia and the Organic Law of 28 December 1990 on the Approval of the Regulations on the National Flag of Georgia shall be repealed.

2. The relevant state bodies specified in this Law shall hoist the national flag of Georgia provided for by this Law on their buildings within one week.

3. The Parliament of Georgia shall, before January 2014, adopt the resolution of the Parliament of Georgia provided for in this Law.

4. A decree issued by the President of Georgia on the basis of this Law shall retain legal force until the entry into force of the relevant resolution of the Parliament of Georgia.

Article 8

This Law shall enter into force upon promulgation.
