LAW OF GEORGIA

ON THE PROCEDURE FOR USE OF THE STATE SYMBOLS OF GEORGIA

 

Chapter I. General Provisions

Article 1 – Scope of the Law

This Law regulates procedures for the use of the national flag of Georgia, the state coat of arms of Georgia, and the national anthem of Georgia, as state symbols of Georgia, and determines the scope of their use and the rules of their protection, as well as the places of storage of the originals of the state coat of arms of Georgia and the national flag of Georgia.

 

Chapter II. National Flag of Georgia

Article 2 – Day of the National Flag of Georgia

January 14 shall be established as the Day of the National Flag of Georgia.

 

Article 3 – Image and dimensions of the national flag of Georgia

1. The national flag of Georgia established by the Organic Law of Georgia On State Symbols of Georgia is the only version of the national flag of Georgia. The use of any other flag as a national flag of Georgia shall be prohibited.

2. It shall be prohibited to change the image (including the colours) of the national flag of Georgia.

3. The dimensions of the national flag of Georgia may be changed in accordance with relevant proportions as determined by the Organic Law of Georgia On State Symbols of Georgia.

 

Article 4 – The place of storage of the original of the national flag of Georgia

1. The place of storage of the original of the national flag of Georgia shall be the residence of the President of Georgia in Tbilisi.

2. The original of the national flag of Georgia shall be kept in a special place designated for it, in conditions that prevent any damage to it.

 

Article 5 – Procedure and conditions for manufacturing the national flag of Georgia

The procedure and conditions for manufacturing the national flag of Georgia shall be determined by a resolution of the Parliament of Georgia.

 

Article 6 – Hoisting and displaying the national flag of Georgia

1. The national flag of Georgia shall be hoisted at all times:

a) on the building of the residence of the President of Georgia;

b) on the building of the Parliament of Georgia;

c) on the buildings of the executive government agencies of Georgia;

d) on the building of the Constitutional Court of Georgia;

e) on the building of the Supreme Court of Georgia;

f) on the building of the National Bank of Georgia;

g) on the building of the State Audit Office;

h) on the building of the Public Defender’s Office of Georgia;

i) on the building of the Office of the Prosecutor General of Georgia;

j) on the building of the Central Election Commission of Georgia;

k) on the buildings of other administrative bodies;

l) on the buildings of the Supreme Representative Bodies of the Autonomous Republics of Abkhazia and Adjara, and on the buildings where the sessions of these Bodies are held, during the whole period of the session;

m) on the buildings of the executive government agencies, enterprises, organisations and institutions of the Autonomous Republics of Abkhazia and Adjara;

n) on the buildings of the municipal bodies, and on the buildings where the meetings of these bodies are held, during the whole period of the meeting;

o) on the buildings of the diplomatic representations and consular offices of Georgia abroad;

p) on ships and other means of maritime transport, if they are registered in Georgia.

2. The national flag of Georgia shall be displayed:

a) on vehicles that serve representations of Georgia abroad;

b) in official international events held in Georgia;

c) on ships, inland waterway vessels and other means of transport, if the President, the Prime Minister, the Chairperson of the Parliament of Georgia, and other persons in their official capacity, are present on board such vessels and representing the State of Georgia under the legislation of Georgia, as well as the heads of the diplomatic representations and consular offices of Georgia abroad.

3. The heads of the institutions specified in this article shall determine other occasions of the use and protection of the national flag of Georgia in their institutions.

Article 7 – Hoisting the flag of the Autonomous Republic of Abkhazia or Adjara or the flag of another country together with the national flag of Georgia in the territory of Georgia

1. If the flag of the Autonomous Republic of Abkhazia or Adjara is hoisted together with the national flag of Georgia in the territory of Georgia, the national flag of Georgia shall be of a larger size and hoisted higher.

2. If a flag of another country is hoisted together with the national flag of Georgia in the territory of Georgia, the national flag of Georgia shall not be of a smaller size than the other flag.

 

Article 8 – Prohibition of use of the national flag of Georgia

1. The use of a damaged, discoloured or otherwise damaged national flag of Georgia shall be prohibited.

2. The violation of the procedure for the use of the national flag of Georgia shall result in liability under the legislation of Georgia.

Article 9 – Protection of the national flag of Georgia

The protection of the national flag of Georgia shall be provided by the relevant state and municipal bodies of Georgia.

Chapter III. State Coat of Arms of Georgia

Article 10 – Forms of display of the state coat of arms of Georgia

1. The state coat of arms shall be displayed in full in colours in accordance with the description provided for by Article 3(2) of the Organic Law of Georgia On State Symbols of Georgia.

2. The small state coat of arms shall be displayed in colours in accordance with the description provided for by Article 3(3) of the Organic Law of Georgia On State Symbols of Georgia.

3. The state coat of arms may be displayed in full in a single colour, using the appropriate heraldic shading of colours and metals (graphic depiction of colours).

4. A small state coat of arms may be displayed in a single colour, using the appropriate heraldic shading of colours and metals.

5. The state coat of arms and the small state coat of arms may be displayed in a single colour, without use of appropriate heraldic shading of colours and metals (in contour only).

6. The state coat of arms may be displayed in a single colour, with or without the appropriate heraldic shading.

 

Article 11 – Place of storage of the original of the state coat of arms of Georgia

1. The place of storage of the original of the state coat of arms of Georgia shall be the residence of the President of Georgia in Tbilisi.

2. The original of the state coat of arms of Georgia shall be kept in a special place designated for it in conditions that prevent any damage to it.

 

Article 12 – Scope of use of the state coat of arms of Georgia

1. The state coat of arms shall be displayed in full on the legal acts, blank forms, seals and stamps of the following state bodies and officials:

a) the supreme state bodies and officials provided for by the Constitution of Georgia;

b) the Central Election Commission of Georgia;

c) the diplomatic representations of Georgia, consular offices and other official representations abroad;

d) the State Security Service of Georgia;

e) the state border checkpoints of Georgia;

f) the military units;

g) the state representatives;

h) the supreme representative and executive bodies of the Autonomous Republics of Abkhazia and Adjara;

i) the common courts of Georgia;

j) the Constitutional Court of Georgia;

k) the Emergency Management Service – a special-purpose state institution directly subordinated to the Prime Minister of Georgia.

2. It is also obligatory to place the state coat of arms in full on the facades of the buildings of the bodies provided for by paragraph 1 of this article, in their meeting halls, and in the working rooms of officials.

3. The state coat of arms shall be displayed in full:

a) when concluding international agreements of Georgia;

b) on the banknotes of Georgia (currency banknotes and coins);

c) on travel documents and identity documents issued by authorised bodies, except for neutral identity cards and neutral travel documents;

d) on Georgian visas issued by an authorised body.

 

Article 13 – Scope of use of a small state coat of arms

1. A small state coat of arms shall be displayed on the standard of the President of Georgia.

2. A small state coat of arms shall be displayed on the legal acts, seals (except for seals used for neutral identity cards and neutral travel documents) and stamps of the following state bodies and officials:

a) the territorial bodies of the executive government agencies of Georgia;

b) administrative bodies, including those to whom has been delegated the authority of state control and supervision.

3. A small state coat of arms only may be displayed on the buildings of the bodies referred to in paragraph 2 of this article and in the offices of officials.

4. A small state coats of arms only shall be displayed on war-ships and other vessels.

5. It is obligatory to bear the relevant state coat of arms on official documents (except for neutral identity cards and neutral travel documents) issued by the bodies and officials provided for by Article 12(1) of this Law and paragraph 2 of this article.

6. Official documents issued by the bodies and officials referred to in paragraph 2 of this article shall bear a small state coat of arms, except for the case specified by this paragraph. The list of official documents issued by the above-mentioned bodies, on which it is obligatory to display the state coat of arms in full, shall be determined by a resolution of the Parliament of Georgia.

7. Non-entrepreneurial (Non-commercial) Legal Entities under Private Law Established by the State as higher education institutions shall use the small state coats of arms.

 

Article 14 – Other occasions of official use of the state coat of arms of Georgia

Other occasions of the official use of the state coat of arms of Georgia may be determined by the Law and/or by a resolution of the Parliament of Georgia.

 

Article 15 – Procedures for the use of the state coat of arms of Georgia

1. In the case of the simultaneous use of the state coat of arms of Georgia and the coats of arms (heraldic symbols) of the Autonomous Republics of Abkhazia and Adjara, municipalities, public associations, and organisations and enterprises, the state coat of arms of Georgia shall be placed (displayed) on the left side (the heraldic right side) of the other coat of arms or heraldic symbol from the position of the viewer standing directly in front of the coat of arms (heraldic symbol).

2. In the case of the simultaneous use of three or more odd number of coats of arms or heraldic symbols, the state coat of arms of Georgia shall be placed (displayed) in the middle of the other coats of arms (heraldic symbols).

3. In the case of the simultaneous use of four or more even number of coats of arms or heraldic symbols, the state coat of arms of Georgia shall be placed (displayed) on the left of the centre (in accordance with the procedure established by paragraph 1 of this article).

4. In the case of the simultaneous use of the coat of arms of Georgia and the coats of arms (heraldic symbols) of the Autonomous Republics of Abkhazia and Adjara, municipalities, public associations, and organisations and enterprises, the other coat of arms or heraldic symbol should not be placed above the state coat of arms of Georgia and should not be larger in size than the state coat of arms of Georgia.

5. It is inadmissible to display the state coat of arms of Georgia and the title of the relevant institution or organisation on the same facia.

6. It is inadmissible that the coats of arms (heraldic symbols) of the Autonomous Republics of Abkhazia and Adjara, municipalities, public associations, and organisations and enterprises exactly imitate the state coat of arms of Georgia, or that the state coat of arms of Georgia be their basis.

7. It is inadmissible to use a damaged state coat of arms of Georgia.

8. The rules for the manufacturing, usage, storage and destruction of blank forms, seals and other means on which the state coat of arms of Georgia is displayed, shall be determined by the Parliament of Georgia.

9. The use of the state coat of arms of Georgia in violation of this Law or the profanation of the state coat of arms of Georgia shall result in liability in accordance with the legislation of Georgia.

10. Individuals, legal entities under private law, political parties and creative unions are prohibited from using the state coat of arms of Georgia on the facades of buildings, letterheads and other official documents, seals and stamps. In other cases, they may use the state coat of arms of Georgia without restriction.

Article 16 – Protection of the state coat of arms of Georgia

The protection of the state coat of arms of Georgia shall be provided by the relevant state bodies of Georgia and the bodies of municipalities.

Chapter IV. National Anthem of Georgia

Article 17 – Procedure for the official performance of the national anthem of Georgia

1. The national anthem of Georgia shall be performed:

a) when hoisting the national flag of Georgia;

b) after the newly elected President of Georgia takes an oath;

c) upon the opening and closing of a session of the Parliament of Georgia;

d) upon recognising the authority of a newly elected Parliament of Georgia after the members of the Parliament of Georgia take an oath; upon electing the Chairperson of the Parliament of Georgia; after recognising the authority of the Supreme Councils of the Autonomous Republics of Abkhazia and Adjara; upon the opening and closing of sessions of the Supreme Councils of the Autonomous Republics of Abkhazia and Adjara; after giving a vote of confidence in the composition of the Government of Georgia; upon electing the Chairman of the Supreme Court of Georgia;

e) upon awarding state awards of Georgia;

f) upon the formal opening of monuments;

g) upon the opening and/or closing of formal events dedicated to the state holidays of Georgia;

h) at the beginning and the end of the academic year in the educational institutions of Georgia.

2. When meeting and seeing off heads of foreign countries and their governments, heads of international organisations, and other officials, the national anthem of Georgia shall be directly performed by a wind orchestra (live performance), or a recording of the national anthem of Georgia (performed by the wind orchestra) shall be performed, after the performance of the national anthem of the country of the guest or that of the international organisation.

3. The choral or orchestral version of the national anthem of Georgia shall be performed on the First Channel of the Public Broadcaster Radio every day at the beginning of the morning broadcasting.

4. The national anthem of Georgia shall be performed in the units of the Georgian Defence Forces and on the floating facilities of the Border Police of Georgia, a state subordinate agency within the governance of the Ministry of Internal Affairs of Georgia, in accordance with the procedure of service in the Border Police of Georgia, a state subordinate agency within the governance of the Ministry of Internal Affairs of Georgia.

5. When holding an official event outside Georgia, the orchestral version of the national anthem of Georgia shall be performed in accordance with the procedure established by the Ministry of Foreign Affairs of Georgia taking into account the traditions of the host country.

6. During official sports competitions, the orchestral version of the national anthem of Georgia shall be performed taking into account existing practice in the relevant sports organisation.

7. During the performance of the national anthem of Georgia, it is obligatory to stand up, and also for men to remove head coverings, except for military servicemen (according to the Regulation of the Georgian Defence Forces) and in cases where removing a head covering is not permitted for religious reasons.

8. If the performance of the national anthem of Georgia is accompanied by the hoisting of the national flag of Georgia, it is obligatory to face the national flag of Georgia.

 

Chapter IV1. State Council of Heraldry

Article 171 – Status of the State Council of Heraldry

1. The State Council of Heraldry is established and operates with the Parliament of Georgia in order to regulate issues related to the state symbols of Georgia and to symbols of state significance.

2. The structure, scope of authority, and main functions of the State Council of Heraldry are determined by this Law and the Statute of the State Council of Heraldry, which is approved by the Parliament of Georgia in accordance with the Rules of Procedure of the Parliament of Georgia.

Article 172 – Scope of authority of the State Council of Heraldry

The competence of the State Council of Heraldry shall include:

a) the development of proposals regarding the state symbols of Georgia;

b) the development of proposals on the use of the state symbols of Georgia;

c) participation in creating the symbols of the Autonomous Republics of Abkhazia and Adjara and self-governing units, and in establishing procedures for their use, and developing appropriate recommendations;

d) participation in establishing procedures for use of the state symbols of Georgia, and other heraldic symbols, during the arrangement of state ceremonies, official events, and military parades, and issuing appropriate recommendations and conclusions;

e) participation in creating the heraldic symbols of the state institutions of Georgia, special clothing (uniforms) and distinctive insignia, departmental awards, and the combination of flags and emblems of the state military and special agencies of Georgia, and in establishing procedures for their use, and issuing relevant recommendations and conclusions;

f) the resolution of other issues related to the state regulation of the state symbols, attributes and emblems of Georgia;

g) the exercise of the powers of the State Council of Heraldry as provided for by the Law of Georgia On Symbols of State Significance.

Chapter V. Final Provisions

Article 18 – Legal acts invalidated in connection with the entry into force of this Law

Upon the entry into force of this Law, the following shall be declared invalid:

a) Resolution No 2856-Iს of the Parliament of Georgia of 30 November 2014 On Determining the Place of Storage of the Original of the National Flag of Georgia (Legislative Herald of Georgia (www.matsne.gov.ge), 05.12.2014, registration code: 010020000.09.001.016247);

b) Resolution No 2857-Iს of the Parliament of Georgia of 30 November 2014 On Determining the Place of Storage of the Original of the State Coat of Arms of Georgia (Legislative Herald of Georgia (www.matsne.gov.ge), 05.12.2014, registration code: 010020000.09.001.016246);

c) Resolution No 2861-Iს of the Parliament of Georgia of 30 November 2014 On the Procedure for Use of a Small State Coat of Arms by Non-entrepreneurial (Non-commercial) Legal Entities under Private Law Established by the State (Legislative Herald of Georgia (www.matsne.gov.ge), 05.12.2014, registration code: 010020000.09.001.016251);

Article 19 – Entry into force of the Law

This Law shall enter into force upon taking an oath by the President of Georgia elected in the next presidential elections.

b) administrative bodies, including those to whom has been delegated the authority of state control and supervision.

3. A small state coat of arms only may be displayed on the buildings of the bodies referred to in paragraph 2 of this article and in the offices of officials.

4. A small state coats of arms only shall be displayed on war-ships and other vessels.

5. It is obligatory to bear the relevant state coat of arms on official documents (except for neutral identity cards and neutral travel documents) issued by the bodies and officials provided for by Article 12(1) of this Law and paragraph 2 of this article.

6. Official documents issued by the bodies and officials referred to in paragraph 2 of this article shall bear a small state coat of arms, except for the case specified by this paragraph. The list of official documents issued by the above-mentioned bodies, on which it is obligatory to display the state coat of arms in full, shall be determined by a resolution of the Parliament of Georgia.

7. Non-entrepreneurial (Non-commercial) Legal Entities under Private Law Established by the State as higher education institutions shall use the small state coats of arms.

 

Article 14 – Other occasions of official use of the state coat of arms of Georgia

Other occasions of the official use of the state coat of arms of Georgia may be determined by the Law and/or by a resolution of the Parliament of Georgia.

 

Article 15 – Procedures for the use of the state coat of arms of Georgia

1. In the case of the simultaneous use of the state coat of arms of Georgia and the coats of arms (heraldic symbols) of the Autonomous Republics of Abkhazia and Adjara, municipalities, public associations, and organisations and enterprises, the state coat of arms of Georgia shall be placed (displayed) on the left side (the heraldic right side) of the other coat of arms or heraldic symbol from the position of the viewer standing directly in front of the coat of arms (heraldic symbol).

2. In the case of the simultaneous use of three or more odd number of coats of arms or heraldic symbols, the state coat of arms of Georgia shall be placed (displayed) in the middle of the other coats of arms (heraldic symbols).

3. In the case of the simultaneous use of four or more even number of coats of arms or heraldic symbols, the state coat of arms of Georgia shall be placed (displayed) on the left of the centre (in accordance with the procedure established by paragraph 1 of this article).

4. In the case of the simultaneous use of the coat of arms of Georgia and the coats of arms (heraldic symbols) of the Autonomous Republics of Abkhazia and Adjara, municipalities, public associations, and organisations and enterprises, the other coat of arms or heraldic symbol should not be placed above the state coat of arms of Georgia and should not be larger in size than the state coat of arms of Georgia.

5. It is inadmissible to display the state coat of arms of Georgia and the title of the relevant institution or organisation on the same facia.

6. It is inadmissible that the coats of arms (heraldic symbols) of the Autonomous Republics of Abkhazia and Adjara, municipalities, public associations, and organisations and enterprises exactly imitate the state coat of arms of Georgia, or that the state coat of arms of Georgia be their basis.

7. It is inadmissible to use a damaged state coat of arms of Georgia.

8. The rules for the manufacturing, usage, storage and destruction of blank forms, seals and other means on which the state coat of arms of Georgia is displayed, shall be determined by the Parliament of Georgia.

9. The use of the state coat of arms of Georgia in violation of this Law or the profanation of the state coat of arms of Georgia shall result in liability in accordance with the legislation of Georgia.

10. Individuals, legal entities under private law, political parties and creative unions are prohibited from using the state coat of arms of Georgia on the facades of buildings, letterheads and other official documents, seals and stamps. In other cases, they may use the state coat of arms of Georgia without restriction.

Article 16 – Protection of the state coat of arms of Georgia

The protection of the state coat of arms of Georgia shall be provided by the relevant state bodies of Georgia and the bodies of municipalities.

Chapter IV. National Anthem of Georgia

 

Article 17 – Procedure for the official performance of the national anthem of Georgia

1. The national anthem of Georgia shall be performed:

a) when hoisting the national flag of Georgia;

b) after the newly elected President of Georgia takes an oath;

c) upon the opening and closing of a session of the Parliament of Georgia;

d) upon recognising the authority of a newly elected Parliament of Georgia after the members of the Parliament of Georgia take an oath; upon electing the Chairperson of the Parliament of Georgia; after recognising the authority of the Supreme Councils of the Autonomous Republics of Abkhazia and Adjara; upon the opening and closing of sessions of the Supreme Councils of the Autonomous Republics of Abkhazia and Adjara; after giving a vote of confidence in the composition of the Government of Georgia; upon electing the Chairman of the Supreme Court of Georgia;

e) upon awarding state awards of Georgia;

f) upon the formal opening of monuments;

g) upon the opening and/or closing of formal events dedicated to the state holidays of Georgia;

h) at the beginning and the end of the academic year in the educational institutions of Georgia.

2. When meeting and seeing off heads of foreign countries and their governments, heads of international organisations, and other officials, the national anthem of Georgia shall be directly performed by a wind orchestra (live performance), or a recording of the national anthem of Georgia (performed by the wind orchestra) shall be performed, after the performance of the national anthem of the country of the guest or that of the international organisation.

3. The choral or orchestral version of the national anthem of Georgia shall be performed on the First Channel of the Public Broadcaster Radio every day at the beginning of the morning broadcasting.

4. The national anthem of Georgia shall be performed in the units of the Georgian Defence Forces and on the floating facilities of the Border Police of Georgia, a state subordinate agency within the governance of the Ministry of Internal Affairs of Georgia, in accordance with the procedure of service in the Border Police of Georgia, a state subordinate agency within the governance of the Ministry of Internal Affairs of Georgia.

5. When holding an official event outside Georgia, the orchestral version of the national anthem of Georgia shall be performed in accordance with the procedure established by the Ministry of Foreign Affairs of Georgia taking into account the traditions of the host country.

6. During official sports competitions, the orchestral version of the national anthem of Georgia shall be performed taking into account existing practice in the relevant sports organisation.

7. During the performance of the national anthem of Georgia, it is obligatory to stand up, and also for men to remove head coverings, except for military servicemen (according to the Regulation of the Georgian Defence Forces) and in cases where removing a head covering is not permitted for religious reasons.

8. If the performance of the national anthem of Georgia is accompanied by the hoisting of the national flag of Georgia, it is obligatory to face the national flag of Georgia.

 

Chapter IV1. State Council of Heraldry

Article 171 – Status of the State Council of Heraldry

1. The State Council of Heraldry is established and operates with the Parliament of Georgia in order to regulate issues related to the state symbols of Georgia and to symbols of state significance.

2. The structure, scope of authority, and main functions of the State Council of Heraldry are determined by this Law and the Statute of the State Council of Heraldry, which is approved by the Parliament of Georgia in accordance with the Rules of Procedure of the Parliament of Georgia.

Article 172 – Scope of authority of the State Council of Heraldry

The competence of the State Council of Heraldry shall include:

a) the development of proposals regarding the state symbols of Georgia;

b) the development of proposals on the use of the state symbols of Georgia;

c) participation in creating the symbols of the Autonomous Republics of Abkhazia and Adjara and self-governing units, and in establishing procedures for their use, and developing appropriate recommendations;

d) participation in establishing procedures for use of the state symbols of Georgia, and other heraldic symbols, during the arrangement of state ceremonies, official events, and military parades, and issuing appropriate recommendations and conclusions;

e) participation in creating the heraldic symbols of the state institutions of Georgia, special clothing (uniforms) and distinctive insignia, departmental awards, and the combination of flags and emblems of the state military and special agencies of Georgia, and in establishing procedures for their use, and issuing relevant recommendations and conclusions;

f) the resolution of other issues related to the state regulation of the state symbols, attributes and emblems of Georgia;

g) the exercise of the powers of the State Council of Heraldry as provided for by the Law of Georgia On Symbols of State Significance.

Chapter V. Final Provisions

 

Article 18 – Legal acts invalidated in connection with the entry into force of this Law

Upon the entry into force of this Law, the following shall be declared invalid:

a) Resolution No 2856-Iს of the Parliament of Georgia of 30 November 2014 On Determining the Place of Storage of the Original of the National Flag of Georgia (Legislative Herald of Georgia (www.matsne.gov.ge), 05.12.2014, registration code: 010020000.09.001.016247);

Article 19 – Entry into force of the Law

This Law shall enter into force upon taking an oath by the President of Georgia elected in the next presidential elections.
